Axia Acceptable Use Policy

By accessing or using services provided by Axia International (“Axia,” “Axia Services”), you agree to comply with this Acceptable Use Policy (“Policy”).
Policy Overview
This Policy describes prohibited uses of the Axia Services and identifies business categories and activities that are not permitted in connection with those services. Axia may take enforcement action if it determines, in its sole discretion, that this Policy has been violated.
Restricted Activities
You may not use the Axia Services in connection with any product, service, transaction or activity that:
- Violates any law or government regulation, or promotes or facilitates such violation by a third party;
- Violates any rule or regulation of any service provider to Axia;
- Is fraudulent, deceptive, unfair or predatory;
- Causes or threatens reputational damage to Axia or any service provider to Axia;
- Involves any of the business categories listed below; or
- Results in, or creates a significant risk of, chargebacks, penalties, damages or other harm or liability.
Certain Business Categories
You may not use the Axia Services in connection with any product, service, transaction or activity that involves:
- Age-restricted products or services;
- Aggregation or factoring, whether licensed or unlicensed;
- Bail bonds;
- Bankruptcy lawyers;
- Bidding-fee auctions;
- Business or investment opportunity sales;
- Chain letters;
- Check cashing;
- Collection agencies;
- Counterfeit goods, or any product or service that infringes upon the copyright, trademark, or trade secrets of any third party;
- Credit card and identity theft protection;
- Credit counseling, repair, or protection services, or mortgage consulting or reduction services;
- Currency exchanges or dealers;
- Decryption and descrambler products designed to circumvent intellectual property rights or protections, including mod chips;
- Drug paraphernalia;
- Embassies, foreign consulates, or other foreign governments;
- Entertainment venues, including nightclubs and bars;
- Essay mills;
- Evading card association chargeback monitoring programs;
- Extended warranties;
- Real estate purchases with no money down;
- Flea markets;
- Fortune tellers;
- Gambling, including but not limited to lotteries, Internet gaming, contests, sweepstakes, or offering of prizes as an inducement to purchase goods or services, unless Axia has provided prior written approval in each instance;
- “Get rich quick” schemes;
- Human hair, fake hair, or hair-extensions;
- Loan modifiers;
- Mail-order brides;
- Marijuana dispensaries and related businesses;
- Money transmitters or money service businesses;
- Multi-level marketing or pyramid schemes;
- Negative response marketing;
- Offering substantial rebates or special incentives to the cardholder after the original purchase;
- Online or other non-face-to-face pharmacies or pharmacy referral services;
- Online or other non-face-to-face tobacco or e-cigarette sales;
- Pseudo pharmaceuticals;
- Prescription drugs, illegal drugs, or substances designed to mimic illegal drugs;
- Prepaid phone cards, phone services, or cell phones;
- Pre-payment services;
- Products or services that promote hate, violence, harassment, or abuse;
- Quasi-cash or stored value;
- Securities brokers;
- Sexually oriented or pornographic products or services;
- Sharing cardholder data with another merchant for payment of up-sell or cross-sell products or services;
- Shipping or forwarding brokers;
- Social media activity sales, such as sales of X followers, Facebook likes, Youtube views;
- Sports forecasting or odds making;
- Telemarketing;
- Timeshares;
- Virtual currency or credits that can be monetized, re-sold, or converted to physical or digital goods or services, or that otherwise exit the virtual world; and
- Weapons and munitions.
Actions by Axia
If, in Axia’s sole discretion, Axia believes that you may have engaged in any violation of this Policy, Axia may, with or without notice to you, provided that Axia will use reasonable efforts to provide notice where commercially practicable, take any actions it deems appropriate to mitigate risk to Axia and any impacted third parties and to ensure compliance with this Policy. Such actions may include, without limitation:
- Blocking the settlement or completion of one or more transactions or other Axia Services;
- Suspending, restricting, or terminating your access to and use of the Axia Services;
- Terminating Axia’s business relationship with you, including termination of any service agreement between you and Axia;
- Taking legal action against you;
- Contacting and disclosing information related to such violations to any financial institutions involved with your business or transactions, law enforcement or regulatory agencies, and other third parties that Axia reasonable believes may have been impacted by such violations; or
- Assessing against you any fees, penalties, assessments, or expenses, including reasonable attorneys’ fees, that Axia may incur as a result of such violations, which you agree to pay within thirty (30) days after notice.
Amendments
This Policy may be amended by Axia at any time by posting a new version to its website. Axia will use reasonable efforts to provide advance notice of material changes. By accessing or using the Axia Services after a new version is posted, you agree to all amendments reflected in that version.
